3月1日新增植入基因编辑、克隆胚胎,非法采集和走私人类资源等新罪名进入刑法!附解读:

2月27日,最高法、最高检发布《最高人民法院、最高人民检察院关于执行〈中华人民共和国刑法〉确定罪名的补充规定(七)》,该规定自2021年3月1日起与《刑法修正案(十一)》同步施行。

《罪名确定补充规定(七)》新增17个罪名,另对原10个罪名作了调整或者取消,其中包含了此前就备受关注的袭警罪、负有照护职责人员性侵罪、冒名顶替罪、高空抛物罪等。

梅斯医学小编注意到,此次新增非法采集人类遗传资源,走私人类资源材料罪;非法植入基因编辑、克隆胚胎罪;可谓与时俱进。也反映了国家对人类遗传资源管理的加强。

有关对非法植入基因编辑、克隆胚胎罪的定义,可能后续仍然需要解释。从字面上看,非法植入基因编辑、克隆胚胎罪,中间为顿号,即非法植入基因编辑胚胎是非法的,对于采用基因编辑治疗疾病(如肿瘤,先天性遗传性疾病),应该仍然属于科学研究范围,具体可能有待后续官方进一步解释

另外,还新增妨碍药品管理罪对假药与劣药,从此前的生产与销售,新增了提供,使得打击面更为宽泛。因此,未来只要是与假药劣药相关的(哪怕从中未赚钱的),也不可以从事,否则可能会触犯刑法。

另外,对新冠肺炎明确作为甲类传染病管理。实际上,中华人民共和国国家卫生健康委员会2020年第1号公告指出:经国务院批准,将新型冠状病毒肺炎纳入《中华人民共和国传染病防治法》规定的乙类传染病,并采取甲类传染病的预防、控制措施。二者是一致的,即管理按甲类传染病,但是疾病归为乙类传染病。
