有地方规定医疗纠纷私下调解索赔限额 卫健委回应

国家卫生健康委员会今日就《医疗纠纷预防和处理条例》有关情况举行新闻发布会。有记者问，之前各地出台了关于医疗纠纷处理有一个规定，如果索赔超过2万元不能私下调解，新《条例》10月1日出台以后，对这方面有什么指导意见没有？

郭燕红对此表示，《条例》当中给了大家多种的解决途径，包括院内的医患协商、人民调解、行政调解、司法诉讼。前期一些地方的法规规章中有一个非常好的经验，把它进行了数额的限定，有的地方规定了2万，有的规定是1万，使得院内协商的裁量权能够减少到一个最可控的范围内。

郭燕红指出，《条例》更要关注各地的差异性，很难用一个限额的标准来框定院内协商和引入院外人民调解的界限。所以，《条例》规定不能够畸高或畸低来表述，既尊重地方实践又不在国家的层面上设定一个简单的数额，更有利于这个《条例》在多种途径解决医疗纠纷中所发挥得效率。
