医保局婉拒“上调院外专家会诊费”：“飞刀”到底值多少钱？

翁国星等7位全国人大代表建议将院外专家会诊费参照律师收费标准，上调至500至5000元/小时或5000至50000元/件；或者参照全国知名专家授课费标准1500元（每学时40分钟），上调至11250元（手术时长300分钟），促进院际会诊方便病人得到最佳治疗。
 
医保局回复：“我们将稳妥有序试点探索医疗服务价格改革和优化，平衡好医疗事业和各方承受能力，促进医疗资源有效供给和均等化，同时配合有关部门深入推进公立医院薪酬制度等相关改革，充分反映医务人员技术劳务价值。”
 
飞刀：市场需求下的时代产物
 
院外专家会诊中的很大一部分其实就是所谓的“飞刀”。上世纪九十年代以来，在市场供需机制的调节下，许多“身怀绝技“的外科医生们开始接受邀请，利用周末等休息时间，飞往外地为患者开刀，“飞刀”一词由此得来。
 
飞刀出现的原因主要来自三种需求：医疗资源分配不均衡造成的患者需求，医生增长收入与扩大影响力的个人需求，以及基层医院渴望专家带教的学习需求。
 
我国仍处于并将长期处于社会主义初级阶段的基本国情之下，区域经济发展不均衡是难以回避的问题，而与之相伴随的，还有医疗资源分布的不均衡。
 
北京上海等一线城市的三甲医院一床难求，就医过程中所要花费的时间成本和经济成本更加高昂，能够请专家来飞刀，对三四线城市甚至是偏远县城的患者来说，不失为一种性价比极高的选择。
 
与此同时，医生凭借业务能力获取额外收入，基层医院获得学习先进手术技术的机会，可谓是三方共赢的结果。
 
 
多点执业：政策让飞刀“阳光化”了吗？
 
虽然医生飞刀存在如此之多的合理性，却为何依旧处于灰色地带？这要从1999年的《执业医师法》说起。
 
在90年代初期，《执业医师法》尚未颁布，那是一段医生享有“自由执医”权力的年代，也是属于“飞刀”的黄金年代。然而缺乏监管的自由下，也衍生了各种医疗纠纷，1999年国家正式颁布《中华人民共和国执业医师法》，规定医师只能在唯一的医疗机构注册后才具有行医资格，这意味着“飞刀”成为违法行为。
 
2005年卫生部出台了《医师外出会诊管理暂行规定》，规定医生外出会诊，医院和医院之间的会诊要有书面申请，医生应该经过所在医院同意并登记备案后，才能出诊；未经所在医疗机构批准，医生不得擅自外出会诊。同时也对会诊费用作出了相关规定，但并未发布指导价。
 
2014年11月卫计委发布《关于推进和规范医师多点执业的若干意见》，首次提出对医师多点执业实行注册管理。2017年2月，卫计委颁布《执业注册管理办法》，终于第一次明确，医生可以在其它医疗机构执业，只需备案即可，无需注册医疗机构的许可。
 
但值得注意的是，执业地点是指执业医师执业的医疗、预防、保健机构所在地的省级行政区划和执业助理医师执业的医疗、预防、保健机构所在地的县级行政区划。
 
这确实将医师的执业范围进行了一定程度的扩大，但可能仍然无法满足大家的需要。许多患者所渴望得到的跨省范围医疗服务，仍然缺乏相应的法规保护。
 
飞刀之痛：农夫与蛇的故事何时停止
 
长期以来“飞刀”形成的巨大惯性，并不会因为合适法规的缺席而停止，但却成为了一些患者事后反悔的机会，所谓“农夫与蛇”的故事，数见不鲜。
 
2018 年 12 月，齐齐哈尔医学院附属三院骨科医生请外院专家为患者做手术，收受了患者家属给外院专家的 5000 元会诊费，被当成在医疗服务中索要红包被举报；
 
2019年9月，北京天坛医院专家“飞刀”前往山西洪洞县为脑梗患者手术，术后被举报收取10000元红包，并有偷拍视频为证；
 
2020年11月，大庆第五医院经患者同意后邀请哈尔滨一专家前来手术，并支付3700元“飞刀费”，后因不满手术台次延后反手向媒体投诉医院违规收费；
 
2021年7月，上海一专家前往河南滑县新区医院为患者开展斜颈手术，在收取3000元专家费时被患者家属偷拍，家属向媒体曝光要求维权。
 
除了手术成功被倒打一耙的案例，我们无法回避的还有“飞刀”术后结局不理想的医疗纠纷。医疗行为本身存在各种风险，即便是在医生原本的医院开刀，也存在发生术后并发症，甚至造成患者死亡的可能性。
 
“飞刀”模式下，主刀医生只能参与手术环节，术前评估不足，术中与助手配合不默契，对当地医疗器械不熟悉，术后无法查房监测，围手术期护理水平存在差异……这些都是当前环境下不可否认的弊端，也可能成为产生医疗纠纷的导火索。
 
2021年8月20日，新版《中华人民共和国医师法》通过决议，再次明确了“多点执业”的合法性，鼓励医生“多点执业”。国家推动优质医疗资源下沉的决心有目共睹，但在没有明确法律保护下的“飞刀”，还请诸君慎之又慎。保护好自己，让我们一起期待如文章开头所描绘的，医生的另一个“黄金年代”。
